1. What the service is

pokrok is a hosted workspace in which software agents carry out the jobs your team repeats: work that runs on a schedule, or that starts when work arrives from a service you have connected. Each customer gets their own instance at their own web address, with its own storage and its own database.

These terms are between you and Anypreta s.r.o.. You can sign up as a business or as an individual, and where something applies to only one of those, it says so. If you are signing up for an organisation, you are telling us you may enter into this agreement on its behalf, and "you" means that organisation from then on. Either way you need to be old enough and able to enter into a contract; if you are under eighteen, ask somebody who is.

You accept these terms by ticking the box on the sign-up form. We record when you did it and which version was in front of you at the time, because the version you accepted is the one that binds you - not whatever this page happens to say later.

2. What a subscription buys

Access to your own instance at your own web address, with its own storage and its own database, and the use of the models it comes connected to. What a subscription costs and what it includes are on the pricing page and form part of these terms.

Payment is taken by our payment processor on their own checkout page. We never see or hold your card details. A subscription renews for successive periods until you cancel it.

Where a ceiling on model use applies to your workspace, that ceiling is what your subscription includes. More is available by arrangement: ask us and we will agree it with you rather than bill you for it silently.

3. Your account

The first account created in your instance becomes its administrator, so create it before you give the address to anybody else. You decide who else gets access, and you are responsible for what the people you admit do with it.

You are also responsible for the connections and credentials you give your agents. An agent can reach an outside service only where you have granted it that, and where you grant it, what happens at that service is between you and them.

4. Acceptable use

Use the service lawfully and do not use it to harm other people. In particular, do not use it to infringe somebody else's rights, to send unlawful or abusive material, to attack our infrastructure or anybody else's, to work around the limits or ceilings that apply to your workspace, or to resell access to people outside your organisation without agreeing that with us first.

The service is not built for uses where a failure would cause death, personal injury or comparable harm, and it must not be relied on for one.

5. Your content stays yours

Everything you put into your workspace remains yours. We claim no ownership of it and we do not sell it. We process it to run the service for you, which includes sending conversations to our model provider so that a model can answer them.

What happens to content once it reaches that provider is set out in the privacy policy, which also explains what our zero-retention setting does and does not cover. We would rather point you there than make a broader promise here than our provider arrangement supports.

6. Availability

We run the service, we watch it, and we fix what breaks. We take it down for maintenance when it needs it and we try to do that when it costs you least.

We do not sell an uptime figure with an ordinary subscription, and you should not plan on the basis of one. If your organisation needs a service level written down and agreed, that is an Enterprise arrangement and we will discuss it with you.

7. Suspension and termination

You can cancel at any time, and cancellation takes effect at the end of the period you have already paid for.

We may suspend or end your subscription if payment fails, if these terms are broken, or if what your instance is doing threatens the service or other customers. Except where the problem is urgent enough that waiting would make it worse, we will tell you what the problem is and give you a chance to put it right first.

We may also end a workspace without giving a reason. A free workspace we may stop at any time, telling you first. A paid subscription we may end with at least thirty days' notice, and where we do we refund the part of the period you have paid for and not used. We would rather tell you why, and normally will, but running a service means occasionally deciding not to carry on with an arrangement without having to argue the case.

Either way your data is not destroyed on the day. It follows the same course as any stopped instance, described in the next section, and the export is yours to take throughout.

8. What happens to your data when it ends

Take your export first. You can download one from Settings at any time, and the privacy policy sets out exactly what is in it by default and what you have to ask for.

When a subscription is cancelled or goes unpaid, your instance is stopped rather than deleted, normally once the period you paid for has ended. Its data stays on our servers.

A stopped instance is removed ninety days later, with everything in it. That is a scheduled job rather than somebody's decision, it cannot be undone, and afterwards we hold no copy. We write to the address on your account a fortnight before it happens, and if you tell us at any point before then that you want the workspace kept, we keep it.

To have it deleted, ask us at info@anypreta.com and we will do it. A deletion takes the whole instance: its database, its uploaded documents, its container workspaces and any backups. We are building a routine deletion schedule, and when it is running these terms will say so.

9. Limitation of liability

Nothing here limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, for fraud, or any mandatory right you have as a consumer.

Subject to that, we are not liable for indirect or consequential loss, for lost profits, revenue, goodwill or anticipated savings, or for loss of data that an export you could have taken would have preserved. Our total liability in connection with the service in any twelve month period is limited to the fees you paid us for the service in that period.

Agents act on instructions you give them and on the access you grant them. You are responsible for reviewing what a routine does before you let it run unattended, and for the consequences of the permissions you hand out.

10. Changes to these terms

When these terms change the new version appears here with a new date at the top, and where the change is material this page says what changed and the date it takes effect. We will also write to the address on your account before that date rather than rely on you to notice, and a change to these terms is a person writing to you rather than one of the automatic account notices. Continuing to use the service after that date means accepting the new version; if you would rather not, cancel and the change never binds you.

11. Changing your mind, if you are a consumer

If you are buying as a consumer rather than for a business, you have fourteen days from the day the subscription starts to change your mind, for any reason or none. Tell us at info@anypreta.com, or from your account page, and that is enough - there is no form to fill in and you do not have to say why.

Because your workspace is built the moment you pay, you are asking us to start during those fourteen days. That is what you are agreeing to when you sign up, and it has one consequence worth stating plainly: if you then withdraw, you pay for the part of the period you had the service, rather than nothing at all. We refund the rest within fourteen days of you telling us, by the same means you paid.

None of this takes away anything the law of the country you live in gives you. Where that law is more generous than this section, it wins.

12. Governing law and disputes

These terms are governed by the law of the Czech Republic, and the courts of the Czech Republic have jurisdiction over any dispute arising from them. Any mandatory protection available to you under the law of the country you live in is unaffected.

Write to us first. Most things are settled that way, and we would far rather hear about a problem than read about it. If you are a consumer and we cannot settle it between us, you can take it to the Czech Trade Inspection Authority (Česká obchodní inspekce), which handles out-of-court consumer disputes: coi.cz. That costs you nothing, and it does not stop you going to court instead if you would rather.
